General Conditions of Sale (GSC) for purchases made online on the website www.casabella.com .
Casa Bella Srl, Località Socciso, Strada Provinciale per Carpaneto, 29014 Castell'Arquato (PC), VAT number 01066790336 (CASA BELLA) invites users to read these General Conditions of Sale (“CGV”) which regulate the purchase of the products and the management of orders placed on the site.
1. INTRODUCTION
1.1 The sale of products concluded remotely through the website www.casabella.com (hereinafter referred to as the “Website” or “Site”) is governed by the following General Conditions of Sale.
The products offered on e-commerce are sold directly by CASA BELLA.
1.2 The use of the distance selling service regulated in these General Conditions of Sale is reserved exclusively for consumers (hereinafter referred to as "Customer" or "Customers") understood as natural persons acting for purposes not related to their commercial activity , entrepreneurial, artisanal or professional activity, if any, over the age of 18 (or, if minors, authorized by their legal representative).
The resale or transfer for any commercial or professional purpose of the products purchased on e-commerce is expressly prohibited.
1.3 The products offered for sale on e-commerce can be delivered throughout Italy, including the islands.
1.4 The language used for the conclusion of the sales contract through this shop is Italian.
1.5 These General Conditions of Sale are published on the Website in order to allow knowledge, storage and reproduction by the Customer in accordance with current legislation.
1.6 The purchase of products is governed exclusively by the General Conditions of Sale published on the Website and in force at the time of purchase. CASA BELLA reserves the right to make changes and/or additions to these General Conditions of Sale at any time. Any changes and/or additions will be effective exclusively in relation to purchases made after the date of publication of the new version of the General Conditions of Sale. The replacement of these General Conditions of Sale with a new version implies the automatic inapplicability, ineffectiveness and unenforceability of the same against CASA BELLA in relation to purchases made subsequent to their elimination from the Website and this even in the case in which said General Conditions of Sale were in any case consultable and/or accessible to the public through other websites, other than the one indicated above.
2. AVAILABILITY OF PRODUCTS
2.1 Except in the case of the purchase of Personalized or tailor-made Products (see point 3.9 of these GCS), an option which, if activated, will be specifically indicated on the Site, the Customer acknowledges that the products offered by CASA BELLA are those present on the Website (hereinafter referred to as the “Products”) whose availability is to be verified at the time of purchase.
2.2 Inconveniences may occasionally occur in relation to the availability of certain products. In this case, CASA BELLA will promptly inform the Customer via e-mail, agreeing on the management of the order.
2.3 CASA BELLA reserves the right to vary the items offered for sale on the Website at any time, without notice.
3. PURCHASE PROCEDURE
3.1 The Customer can purchase the products present on the e-commerce page of the site when placing the order.
The Products are presented on the site accompanied by photographic images, unit price, description and any other specifications based on the selected product.
Prices, descriptions and availability of products displayed are subject to change without notice. The photos included are indicative and may not constitute an exact representation of the products.
3.2 Although CASA BELLA constantly adopts measures aimed at ensuring that the photographs shown on the Website faithfully reproduce the original products, some variations are always possible due to multiple factors including, by way of example and not limited to, monitor of the Customer's terminal, filters photography etc…
Consequently, CASA BELLA will not be responsible for any inadequacy of the graphic representations of the Products shown on the Website if due to the aforementioned technical reasons. The user acknowledges and accepts that any minor differences do not constitute a lack of conformity of the products.
3.3 To view the selected Products and the total price of the purchase order it is necessary to access the Cart page.
The Customer, before confirming his purchase, is required to verify the accuracy of the contents of the Cart and complete the procedure according to the instructions provided on the Website.
3.4 The purchase procedure ends when the Customer confirms the order, which will be sent directly to CASA BELLA.
Once the purchase order has been sent, its content can no longer be modified by the Customer.
3.5 Before definitively confirming the order, the Customer must declare that they have read and accepted these General Conditions of Sale. At the end of the purchase procedure, the Customer should save or print the General Conditions of Sale.
3.6 The purchase procedure must be completed in full; otherwise the order will not be completed and therefore will not be sent to CASA BELLA.
3.7 The orders and Customer data necessary for the purchase will be archived by CASA BELLA for the period of time and in compliance with the conditions established by current legislation. Any use of data for purposes other than purchasing will be subject to the Customer's prior and express consent, based on the provisions of the "Privacy Policy" on the Website.
3.8 The Customer is aware of being responsible for the correctness and truthfulness of the data entered on the Website during the purchase phase.
3.9 If the option is indicated, the Customer acknowledges the possibility of ordering Personalized products on the Website, for which the relative delivery times will be indicated.
3.10 All further details relating to payment, delivery and confirmation of Personalized Products are specified in the respective sections below.
4. CONCLUSION OF THE CONTRACT
4.1 Following confirmation of the Order, it is sent to CASA BELLA to be processed and cannot be further modified or cancelled.
The Order will be confirmed only if the entire purchase procedure has been completed regularly, without any indication of an error on the part of the Website.
4.2 The contract stipulated between CASA BELLA and the Customer must be considered concluded when the Customer receives one or more confirmation emails from CASA BELLA (hereinafter referred to as "Confirmation Email").
The Confirmation Email will be sent to the address indicated by the Customer in the purchase form and will contain the confirmation and summary of the conditions of the purchase itself.
In particular, the Confirmation Email will contain the date and time of receipt of the order and an "Order Number" to be used in any further communication with CASA BELLA.
4.3 CASA BELLA reserves the right to cancel the purchase order received, with consequent communication to the Customer of the cancellation and consequent refund of the purchase amount.
5. PRICE AND PAYMENT METHODS
5.1 The prices of all Products offered for sale on the Website include VAT.
5.2 These prices will be indicated in Euros (EUR).
5.3 The total amount of the price shown in the Cart includes any shipping costs, which will be indicated separately.
CASA BELLA reserves the right to change the prices of the Products offered for sale on the Website at any time and without notice.
5.4 CASA BELLA only accepts the payment methods expressly indicated on the Website.
5.5 For the purposes of payment by credit card, the Customer confirms and guarantees that he is the owner of the credit card used for the purchase and the correctness of all data relating to it, entered during the purchase phase, such as: the number, the expiry date and, if necessary, the security code.
5.6 For the purposes of payment through any other payment service providers, the Customer confirms and guarantees that he is the owner of the account used for the purchase.
The transaction will be charged to the Customer only after the latter has received the Confirmation Email from CASA BELLA.
5.7 The shipment of the purchased Products will be carried out only after the payment of the amount due by the Customer has been successful.
6. DELIVERY
6.1 The Products will be shipped to the address indicated by the Customer in the Order. The Customer's signature will be required upon delivery of the Products.
6.2 The Products sold on the Website may be delivered throughout Italy, including the islands.
6.3 Shipping costs will be expressly indicated, separately from any other cost or expense, at the conclusion of the order process.
6.4 Except for specific indications on delivery times relating to customized Products and except for causes of force majeure or setbacks which will be promptly notified to the Customer by CASA BELLA, deliveries of the products will take place in
5 - 7 working days from purchase.
6.5 CASA BELLA uses specialized couriers for the delivery of the Products purchased on the site. Unless otherwise indicated, shipping costs are borne by the Customer and are explicitly highlighted at the time the order is placed.
6.6 The Customer will assume the risk of loss or damage to the Products only when he, or a third party designated by him and other than the carrier, physically comes into possession of such Products.
In the event that, on the contrary, the loss or damage to the Product occurs before the material delivery to the Customer or to a third party designated by him, CASA BELLA will refund the Customer the amounts already paid.
7. PRODUCT CONFORMITY
7.1 Upon delivery, the Products must be checked by the Customer in order to ensure that they correspond to the items ordered and that they do not present manufacturing defects or defects of conformity. The legal guarantees provided for by current legislation are applicable to the sale of the Products, as well as further conventional guarantees that may be provided to the Customer.
7.2 In the event of the existence of manufacturing defects or lack of conformity, the Customer will have the right to restore, without charge, the conformity of the Product through repair or replacement, unless the requested remedy is objectively impossible or excessively onerous compared to the other. If one of the hypotheses provided for by law occurs, the Customer may request an appropriate reduction in the price or termination of the contract and the consequent reimbursement of the price paid. It is understood that the Customer forfeits this right if he does not report the lack of conformity to CASA BELLA within 2 (two) months from the date on which he discovered the defect. In any case, CASA BELLA is responsible only for defects of conformity that appear within 2 (two) years of delivery of the Product and which are not attributable to improper use of the Product by the Customer.
7.3 In order to report the presence of faults and defects in the Products and obtain one of the remedies listed above, the Customer may contact CASA BELLA at the addresses indicated in the following article 11.
8. RIGHT OF WITHDRAWAL
8.1 The Customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the purchased Products, in accordance with correctness and good faith upon written communication to be sent to CASA BELLA via email to the address info@cantinecasabella.com.
In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal.
8.2 The Customer undertakes to return the Products for which he has exercised the right of withdrawal without undue delay and, in any case, within 14 (fourteen) days from the date on which he communicated to CASA BELLA his decision to withdraw from the contract.
8.3 The Products must be returned in the same condition in which they were delivered. The Customer must therefore ensure that the Products are intact and complete, never used or damaged in any way and that they are returned in their original packaging, complete with all accessories that may be included. CASA BELLA reserves the right to refuse the return of those Products that are damaged, deteriorated, or are in such a state as to suggest, unequivocally, that they have been used for purposes other than the Customer checks strictly necessary to ascertain the nature and characteristics of the Product purchased.
In case of refusal of the return for the reasons set out above, CASA BELLA will send a specific communication to the Customer and will not proceed with crediting the price paid by the same, also reserving the right to request compensation for any damage attributable to the Customer's conduct.
8.4 The refund of the price of the returned Products will be carried out by CASA BELLA without undue delay and in any case within 14 (fourteen) days from the date on which CASA BELLA became aware of the exercise of the right of withdrawal by the Customer.
CASA BELLA reserves the right in any case to withhold the refund until it has received and verified the Product. The aforementioned refund will be made by re-crediting the amount paid by the Customer to be carried out with the same payment method used for the purchase, unless the Customer has expressly agreed otherwise and on the condition that he does not have to incur any costs as a consequence of the refund.
CASA BELLA will confirm to the Customer by email that the price has been refunded.
8.5 CASA BELLA will not be required to reimburse the delivery costs of the Products if the Customer has expressly chosen a type of delivery other than the standard one offered by CASA BELLA.
8.6 The return of Products pursuant to this article is permitted only in relation to purchases made on the Website.
8.7 In consideration of the fact that Customized Products are products made specifically for the Customer and that their original production cannot in any way be restored, the right of withdrawal cannot be exercised by the Customer for Customized Products. Consequently, the provisions contained in this article 8 do not apply to Personalized Products, it being understood that the exclusion of the aforementioned products from the right of withdrawal will not prejudice the application of the legal guarantees, provided for in the previous article 7, also to such products.
9. LIMITATION OF LIABILITY
9.1 Except in cases of willful misconduct or gross negligence, CASA BELLA will in no way be liable towards the Customer for indirect or consequential damages that may arise from the purchase of Products offered for sale on the Website.
10. DISPUTES
10.1 These General Conditions of Sale are governed by Italian law and will be interpreted according to it.
10.2 In the event of a dispute arising from the interpretation and/or application of these General Conditions of Sale, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of the municipality of residence of the same Consumer.
In all other cases the Court of Piacenza will have exclusive jurisdiction.
Alternatively, the Customer may promote one of the out-of-court settlement procedures for disputes provided for by current legislation.
